Terms of Service

These Terms of Service ("Terms") govern your use of the ZenJournal mobile application ("the App") provided by MISEON PYO, a sole proprietor registered in the Republic of Korea (Business Registration No. 226-04-37766) ("we", "us", "our"). By installing or using the App, you agree to these Terms. If you do not agree, do not use the App.

1. The Service

• What it does. ZenJournal provides on-device journaling, mood tracking, AES-256 encrypted local storage, optional cloud backup, daily prompts, data export, and on-demand AI Reflection generated by Anthropic's Claude API.
• Where it runs. iOS (iPhone, iPad) via the Apple App Store, and Android via the Google Play Store.
• Availability. We aim for 24/7 availability but may perform maintenance, deploy updates, or experience downtime. We are not liable for service interruptions.

2. Eligibility

You must be at least 13 years old (or 16 in the EU/UK) to use the App. If you are under the age of majority in your jurisdiction, you must have a parent or legal guardian's consent.

3. Your Account & Local Data

• The App does not require you to create an account. Journal entries are stored locally on your device.
• You are responsible for keeping your device secure. We cannot recover entries from a lost or wiped device unless you enabled cloud backup.
• You are responsible for the content you write. Do not write content that violates law or third-party rights, even though it is stored only on your device.

4. Subscriptions & Payments

4.1 Premium Plans

Prices may differ in your local currency and are subject to applicable taxes set by Apple or Google.

4.2 Free Trial

• Monthly and Yearly plans include a 7-day free trial for new subscribers.
• If you do not cancel before the trial ends, the subscription begins automatically and is billed at the standard rate.
• Free trials are limited to one per Apple ID or Google account.

4.3 Auto-Renewal

Monthly and Yearly subscriptions renew automatically unless cancelled at least 24 hours before the end of the current billing period. The renewal is charged to your Apple ID or Google account at the same price as the previous period unless we have given you advance notice of a price change.

4.4 Cancellation

• iOS: Settings → [Your Name] → Subscriptions → ZenJournal → Cancel.
• Android: Google Play Store → Profile → Payments & subscriptions → Subscriptions → ZenJournal → Cancel.
• Cancellation takes effect at the end of the current billing period — you keep Premium access until then.

4.5 Refunds

All payments are processed by Apple or Google. Refund requests are subject to Apple's refund policy or Google's refund policy. We cannot issue refunds directly.

5. AI Reflection & Acceptable Use

• AI Reflection is generated by Anthropic's Claude API based on the text you submit. We do not control or guarantee the AI's output.
• AI Reflection is not medical, psychological, or therapeutic advice. If you are in crisis, please contact a qualified professional or an emergency service.
• You may not use the AI Reflection feature to: generate content that is illegal, defamatory, harassing, or violates third-party rights; attempt to extract or reverse-engineer the underlying model; bypass usage limits; or submit content on behalf of someone else without their consent.
• We may suspend access to AI Reflection for accounts that abuse the feature.

6. User Conduct

You agree not to:

• Reverse-engineer, decompile, or disassemble the App.
• Circumvent or disable encryption, license verification, or other security features.
• Use the App for any unlawful purpose.
• Attempt to disrupt the backend service or other users' use of the App.
• Resell, sublicense, or redistribute the App or any part of it.

7. Intellectual Property

• The App's source code, design, brand, and trademarks are the property of MISEON PYO. We grant you a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.
• Your content is yours. You retain all rights to the journal entries you write. We do not claim ownership and do not use your content to train AI.

8. Privacy

Your use of the App is also governed by our Privacy Policy. Please read it.

9. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will be uninterrupted, error-free, or that data will not be lost.

10. Limitation of Liability

To the maximum extent permitted by law, MISEON PYO is not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill arising out of your use of the App. Our total liability for any claim related to the App will not exceed the greater of (a) the amount you paid us in the 12 months preceding the claim, or (b) USD 50.

Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In those jurisdictions, our liability is limited to the smallest extent permitted by law.

11. Termination

• You may stop using the App at any time by uninstalling it.
• We may suspend or terminate your access to the backend service (including AI Reflection) if you violate these Terms.
• Sections 7, 8, 9, 10, and 13 survive termination.

12. Changes to These Terms

We may update these Terms from time to time. Material changes will be announced in the App at least 30 days before they take effect. Continued use of the App after the effective date constitutes acceptance.

13. Governing Law & Disputes

• These Terms are governed by the laws of the Republic of Korea, without regard to conflict-of-law rules.
• Any dispute arising out of or relating to these Terms will be submitted to the exclusive jurisdiction of the Goyang Branch of the Uijeongbu District Court in the Republic of Korea, unless mandatory consumer-protection law in your jurisdiction requires otherwise.
• Nothing in these Terms limits any non-waivable consumer rights you may have under the laws of your country of residence.
